Promotion of Access to Information Act 2 of 2000

Vula Risk is committed to transparency and to giving effect to the right of access to information in terms of PAIA, subject to the limitations contained in the Act and other applicable legislation.

1. Introduction

This manual is published in terms of section 14 of the Promotion of Access to Information Act 2 of 2000 (PAIA), as amended. It describes the categories of records held by Vula Risk (Pty) Ltd t/a Vula Investigations and explains how a request for access to a record may be made.

3. Purpose of PAIA

PAIA gives effect to the constitutional right of access to any information held by another person and that is required for the exercise or protection of any rights. It also sets out the grounds on which access may be refused.

4. Guide on How to Use PAIA

The South African Human Rights Commission (SAHRC) has published a guide on how to use PAIA. The guide is available in each of the official languages and may be obtained from the SAHRC.

7. Grounds for Refusal

Access to a record may be refused in terms of PAIA where disclosure would reasonably be expected to cause harm to, among others, the commercial or financial interests of Vula Risk, the privacy of a third party, or where the record is subject to legal professional privilege.

8. How to Request Access

A request for access to a record must be made in writing using the prescribed PAIA request form. The form must provide sufficient detail to identify the record requested and must be accompanied by the applicable request fee.

9. Fees

A request fee is payable before a request is processed. Additional fees may be charged for search, preparation, reproduction and postage. The Information Officer will inform the requester of the applicable fees before granting access.

10. Decision Period

Vula Risk will notify the requester of the decision within 30 days of receiving a valid request. This period may be extended by a further 30 days where the request is complex or requires consultation with a third party.

11. Internal Appeal

If a request for access is refused, the requester may lodge an internal appeal with the Information Officer within 60 days of the decision. The requester also has the right to apply to a court for judicial review.

12. Availability of This Manual

This manual is available on our website and may be inspected at our offices during normal business hours upon prior arrangement.
